Acceptance of Terms

By accessing or using ACTS ML ("the Platform"), a project of the African Centre for Technology Studies (ACTS), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

Description of Service

ACTS ML is a free, no-code machine learning platform that enables users to upload datasets, build and train machine learning models, and deploy predictions. The Platform is provided at no cost and is backed by ACTS research and infrastructure.

Account Registration

To use the Platform, you must:

  • Create an account with accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorised use of your account
  • Be responsible for all activities that occur under your account

Acceptable Use

You agree to use the Platform only for lawful purposes. You shall not:

  • Upload datasets containing illegal content or data obtained without proper authorisation
  • Use the Platform to build models that discriminate against or harm individuals or groups
  • Attempt to gain unauthorised access to the Platform's infrastructure
  • Interfere with the Platform's normal operation or other users' access
  • Use the Platform for cryptocurrency mining or other resource-intensive activities unrelated to machine learning
  • Reverse-engineer, decompile, or disassemble any part of the Platform

Your Data

Ownership

You retain full ownership of all datasets you upload and models you create on the Platform. ACTS ML does not claim any ownership rights over your content.

Private Datasets

By default, your datasets are private. Only you and users you explicitly authorise can access them.

Open-Source Datasets

When you mark a dataset as "open-source", you grant all Platform users a non-exclusive, royalty-free licence to access and use that dataset. You represent that you have the legal right to share any data you make open-source.

Data Responsibility

You are responsible for ensuring that any data you upload complies with applicable data protection laws and regulations, including but not limited to Kenya's Data Protection Act (2019).

Platform Availability

ACTS ML is provided free of charge. While we strive for high availability, we do not guarantee uninterrupted access to the Platform. We may:

  • Perform maintenance with or without prior notice
  • Modify or discontinue features at our discretion
  • Impose reasonable usage limits to ensure fair access for all users

Intellectual Property

The ACTS ML platform, including its design, code, and documentation, is the intellectual property of ACTS. The ACTS name and logo are trademarks of the African Centre for Technology Studies.

Limitation of Liability

To the maximum extent permitted by law, ACTS ML and ACTS shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to:

  • Loss of data or datasets
  • Inaccurate model predictions or outputs
  • Decisions made based on model results
  • Service interruptions or downtime

Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that model predictions will be accurate, complete, or suitable for any particular purpose. Users should validate model outputs independently before making decisions based on them.

Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, you may request export of your data within 30 days. After that period, your data may be permanently deleted.

You may delete your account at any time through the Platform settings.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Nairobi, Kenya.

Changes to These Terms

We may revise these Terms from time to time. Material changes will be communicated to registered users via email at least 14 days before they take effect. Continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.
